The Merchant Shipping (Taxation and Other Matters relating to Shipping Organisations) Regulations, initially implemented in 2004 and later amended by L.N. 128/2018, established the Malta Tonnage Tax system. This system exempts shipping companies that own tonnage tax ships from paying taxes on the income generated from shipping activities, as per the Income Tax Act. To qualify for this system, a shipping organization must possess, operate, administer, or manage a minimum of 60% of its overall tonnage under the flag of an EU/EEA state.
